PROBO KOALA The Dutch Court of Appeal overturns district court ruling in move that will allow mass claim to proceed against Trafigura Group by about 100,000 Ivory Coast citizens, who allege they were harmed by 2006 waste dump from ship Probo Koala.... The April 14 judgment overturns previous ruling that found the Ivorian claimants, who were excluded from other settlements involving Trafigura and the Probo Koala, did not have standing The ruling will allow Ivorian claimants, represented by a foundation called Stichting VDTCI (Victimes des dchets toxiques Cte dIvoire), to seek compensation via court The Waste was disposed of in Ivory Coast capital Abidjan and came from ship, Probo Koala, chartered by Trafigura. A Trafigura spokesperson says the appeal court, in overturning the district court ruling, has granted Trafigura permission to appeal to the Supreme Court Trafigura is now considering whether to appeal, but it is notable that the judgment relates only to the admissibility of the Stichtings claim, A spokesperson says in statement. Ces arguments de Trafigura avaient t avancs pour empcher un verdict de la part du juge nerlandais sur la responsabilit de Trafigura envers les victimes ivoiriennes. La Cour dappel a dcid aujourdhui que Trafigura devait rpondre de leurs actions devant le tribunal nerlandais concernant le dversement des dchets du Probo Koala Abidjan. Pour des raisons lgales, le tribunal a d dcider que la procdure contre Trafigura Limited devait se poursuivre au tribunal dAmsterdam et la procdure contre Trafigura Beheer B.V. la Cour dAppel. Le Stichting et Trafigura sont autoriss dposer en cassation; puis la procdure se poursuivra la Cour Suprme.
